The Federal High Court in Abuja has granted permission to Hon. Amobi Ogah, the Member Representing Isiukwuato/Umunneochi Federal Constituency, to compel the Independent National Electoral Commission (INEC) to investigate and prosecute the Minister of State for Labour and Employment, Hon. Nkeiruka Onyejeocha, over alleged forgery of polling unit results used during the 2023 general election.

The ruling, delivered by Justice M. Umar in suit number FHC/ABJ/CS/1308/2025, follows allegations that Onyejeocha forged polling unit results from Isiukwuato and Umunneochi Local Government Areas. These results were allegedly presented during the 2023 election tribunal proceedings and played a role in the nullification of Ogah’s election, a decision later affirmed by the Court of Appeal.

In his decision, Justice Umar stated that the applicant had established sufficient grounds to seek an Order of Mandamus compelling INEC to act in line with its constitutional and statutory duty to investigate and prosecute electoral offences.

The court order reads:

“An order is hereby made granting leave to the applicant to apply for an Order of Mandamus against the respondent, compelling the respondent to investigate and prosecute Nkeiruka Chidubem Onyejeocha for the electoral offence of forging the election results of polling units within the Isiukwuato/Umunneochi Federal Constituency of Abia State.”

The decision represents a major step in Nigeria’s legal and electoral accountability process, as it directs INEC to take concrete action on alleged irregularities tied to the 2023 general elections. The ruling also signals a renewed judicial effort to hold public officials accountable for alleged electoral malpractices, particularly those involving document falsification and result manipulation.
